Terms and Conditions of Sale

This document sets out the terms and conditions (hereinafter, the “Conditions”) governing the online purchase and sale of products available on our website (hereinafter, the “Site”).

We kindly invite you to read the following carefully before placing an order.

If you do not accept these terms, you will not be able to make a purchase.

SECTION 1 – ONLINE STORE TERMS AND CONDITIONS

Our store is hosted on Shopify Inc., which provides the e-commerce platform allowing us to sell the products on the Site, managed by Chateau Isabel S.r.l.s.

By making a purchase, the customer agrees to accept and comply with these Conditions, thereby gaining access to the services offered.

These terms apply to all users of the website, including visitors, vendors, customers, merchants, and/or content creators.

We reserve the right to update, modify, or replace any part of these Conditions by posting updates and/or changes on the Site. It is the user’s responsibility to periodically check this page.

By accepting these Conditions, the user declares that they:

  1. are of legal age in their state or province of residence, or have given consent for minors in their care to use this Site;
  2. will not use our products for illegal or unauthorized purposes or violate any laws in their jurisdiction (including, but not limited to, copyright laws);
  3. will not transmit any worms, viruses, or destructive code.

The user also acknowledges that their content (excluding credit card information) may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform to technical requirements of connecting networks or devices.

Credit card data is always encrypted during network transfer.

SECTION 2 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

Users must provide current, complete, and accurate purchase and account information.

We ask users to promptly update their accounts, especially regarding email address and billing information, credit card numbers, and expiration dates. We may contact users, if necessary, to complete transactions.

If accurate information is not provided, we may be unable to fulfill your order.

SECTION 3 – ORDERING PROCESS

To place an order, users must follow the designated online purchase process: add the desired product to the cart and complete the required fields for order finalization.

By authorizing payment, the user will receive an email confirmation acknowledging receipt of the order, which will include a summary of purchased products, pricing, shipping fees, and payment method.

All orders are subject to our approval, which will be communicated via a second email confirming that the order is being shipped. Only then is the sale considered finalized.

We reserve the right to cancel any order and may attempt to notify you via the email address and/or billing address/phone number provided.

SECTION 4 – PRODUCTS

Essential characteristics of the Products are detailed on the Site in each product description.

We strive to ensure that product images and colors are as accurate as possible; however, discrepancies may occur due to screen settings or technical factors.

Chateau Isabel commits to ensuring product availability as indicated on the Site.

If one or more products become unavailable (even temporarily), users will be informed promptly, and any payments already made will be refunded.

SECTION 5 – PRICES AND PAYMENT METHODS

Product prices are shown in Euros (€) and include VAT. Shipping costs are not included and will be calculated and shown before the order is confirmed.

We reserve the right to modify prices at any time without notice. However, changes will not affect confirmed orders for which a confirmation email has already been sent.

Chateau Isabel accepts the following payment methods:

  1. Credit and debit cards: Visa, MasterCard, American Express, and Maestro;
  2. Apps: PayPal, Google Pay, Apple Pay.

If a payment is declined or cancelled, we suggest contacting your bank or trying an alternative payment method.

Upon receiving the order, we will verify that the selected payment method has sufficient funds to complete the transaction.

Once payment is confirmed, the user will receive an invoice via email at the address provided, along with the order confirmation.

The user’s card will be charged when the order leaves our warehouse.

Installment payment via PayPal is also available if supported in the user’s country and for the total amount of the order.

All transactions are secure and protected through certified encryption systems to ensure the utmost protection of personal and financial data.

SECTION 6 – SHIPPING AND DELIVERY

Once the order has shipped, the user will receive a confirmation email with a tracking number to monitor shipment status on the courier’s website.

We work with various courier partners for shipments within Italy and abroad.

Available shipping countries are shown at checkout in the “Country” dropdown menu.

We offer free shipping for all orders within Italy and Europe.

For orders outside Europe, a €30 shipping fee applies.

For non-EU countries, Chateau Isabel usually covers customs duties and fees, though exceptions may apply for certain destinations.

Estimated delivery times from shipment confirmation:
• 3 business days for deliveries within Italy;
• 5 business days for remote areas and islands in Italy;
• 5 business days for deliveries within Europe;
• 10 business days for the rest of the world.

During peak periods (e.g., sales or holidays) or customs checks, delays may occur.

Orders will be delivered to the address provided at checkout.
If delivery is delayed:
• Check the tracking number;
• Contact the courier directly;
• Reach out to us at hello@advista.world for assistance.

SECTION 7 – EXCHANGE POLICY

We only accept exchange requests if the item (e.g., bag) is damaged or defective upon delivery.

Please contact us within 7 days of receiving the item, including photos documenting the issue.

Once approved, we will replace the product and refund the shipping costs incurred.

Exchange requests must be made within 7 days of delivery.

Remember, exchanges are only allowed for items damaged or defective upon receipt.

Please keep the original packaging and send us clear photos so we can assess the issue.

Exchanges are completely free in such cases.

Shipping costs for returning the item will be fully refunded once the exchange is completed (i.e., once you have received the replacement and we have received the returned item).

After receiving and verifying the returned item, we will produce and ship the replacement.

Due to artisanal production and shipping time, the exchange process may take 2 to 4 weeks.

Refunds for shipping costs will be issued using the same payment method used for the original purchase once the exchange is complete.

SECTION 8 – RIGHT OF WITHDRAWAL

In purchases with a consumer user, the right of withdrawal may be exercised in accordance with Articles 52 and following of the Italian Consumer Code (Legislative Decree 206/2005), without providing any justification or incurring penalties.

Withdrawal must be communicated within 14 days of receiving the product.
If multiple items from the same order are delivered separately, the 14-day period begins upon delivery of the last item.

To exercise the right of withdrawal, the consumer must send an explicit declaration specifying the intent to withdraw from the purchase (no explanation required), indicating the product(s) to be returned and attaching proof of purchase.

As per Article 59, letters (c) and (d) of the Consumer Code, withdrawal is not permitted for:
• customized or made-to-order items;
• products likely to deteriorate or expire quickly;
• sealed items that are unsuitable for return due to hygiene or health reasons once opened (Article 59(i)).

Returned items must be received within 14 days of the withdrawal notice.
Items must be substantially intact, in original packaging, and include all accessories and manuals.

Once the return request is received, Chateau Isabel S.r.l.s. will refund all payments within 14 days using the same payment method.
Refunds may be withheld until the products are received.

If the return is not made according to these Conditions, no refund will be issued.
Return shipping costs are borne by the consumer.

SECTION 9 – REFUNDS

The return policy can be reviewed during checkout in the footer of the Site.

SECTION 10 – LIMITATION OF LIABILITY

Chateau Isabel is not liable for most damages or losses you may incur by using the Site or purchasing products.

Specifically, we disclaim liability for:
• direct or indirect damages;
• issues arising from use of the service or products.

Therefore, the user accepts full responsibility when using the services, with our liability limited strictly as required by applicable law.

SECTION 11 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Chateau Isabel and its parent company from any third-party claims or demands, including reasonable legal fees, arising from your breach of these Terms or violation of any law or third-party rights.
